GYPOACF Raffle Terms and Conditions

1.General. By participating in the Goodyear Police Officers Association Charity Foundation (the“Charity”) 2017 Rifle and Handgun Raffle (the “Raffle”), entrants agree to be bound by these Official Rules and by the decisions of the Charity, which shall be binding and final as to all matters related to the Raffle. The Raffle is subject to all applicable federal, state, and local laws and is void where prohibited.

2.Net Proceeds. All net proceeds of the Raffle will benefit the Charity, a 501(c)(3) organization.

3.Eligibility. The Raffle is open to all persons age twenty-one (21) and older that are residents of the State of Arizona and subject to these Official Rules.

4.Purchasing Raffle Tickets. All Raffle tickets (“Raffle Tickets”) shall be purchased one (1) Raffle Ticket for $20.00. Tickets will be available for purchase from November 30, 2016 to noon April 29, 2017, from any of the members of the Board of Directors of the Charity, online at gypoacharity.org and at various events and locations associated with the Charity. There is no limit to the number of Raffle Tickets an individual may purchase. Each entrant will receive a receipt corresponding to his/her purchased Raffle Ticket(s). Entries which are or appear to be tampered with are void. The Charity shall be the sole judge of the validity and eligibility of all entries. All Raffle Ticket purchases shall be final, and no refunds or replacements will be issued by the Charity.

5.Tax Deductible. The Raffle Ticket buyer shall determine to what extent and/or what portion of the price of the ticket may be tax deductible.

6.Prize. Two (2) Prize winners will be chosen. The first Raffle Ticket drawn will be awarded the Cobalt Kinetics B.A.M.F. Assault Rifle. The second Raffle Ticket drawn will be awarded the Glick 19 with Trijicon Night Sights. The Cobalt Kinetics B.A.M.F. AR is valued at approximately $2,499, and the Glock 19 with Trijicon Night Sights is valued at approximately $1,235. Each winner must successfully complete a background check to consummate the transfer of the applicable firearm. Four additional Raffle Tickets will be drawn in the event that the first and/or second Raffle Ticket winner(s) fails to satisfy the requirements to consummate the transfer of the applicable firearm.

7.Taxes. Each Raffle Ticket winner shall be responsible for any and all additional costs, federal, state and local income or excise taxes, fees, assessments and like charges associated with a prize. Federal and state withholding laws are subject to change without notice. The federal and state withholding laws in effect at the time each prize is claimed will be followed.

8.Selection of Winner(s). Winning Raffle Tickets will be drawn by the Charity no later than April 29, 2016. The Charity will determine the winner of the prizes. The number and name of the winning Raffle Tickets will be announced at the Charity Guns and Hoses Golf Tournament located at the Wigwam Resort, 300 E. Wigwam Blvd. in Litchfield Park, Arizona. Winners will also be announced online at gypoacharity.org and on Facebook after the drawing. Winners need not be present to win.

9.Prize Claim. Within one hundred eighty (180) days of the drawing, the prize claimant must notify the Charity and present the winning Raffle Ticket in-person to a member of the Board of Directors of the Charity or email treasurer@gypoacharity.org. Each prize claimant must provide the Charity or a designated third party with all information required to claim a prize (including tax identification and background information). The prize claimant will receive a Winning Certificate and W9 which must be executed and returned to the Charity no later than five (5) business days after his/her receipt of the documents. In the event a claimant: (a) does not notify the Charity within one hundred eighty (180) days of the drawing; (b) is ruled ineligible for any reason, including a failure of the background check;(c)refuses the prize; or (d) does not return any required documents, the prize will be forfeited and will be retained by the Charity for charitable use, to include being awarded to a runner up Raffle Ticket
winner. The Charity has no obligation to contact potential winner(s). Winner(s) must notify the Charity a minimum of thirty (30) days prior to redeeming prize.

10.Odds. The odds of winning the Raffle depend on the number of Raffle Tickets purchased for thedrawing. The maximum number of Raffle Tickets that may be sold is 1,250.

11.Transfer of Raffle Tickets or Prize. Persons who purchase Raffle Tickets may opt to give away theirRaffle Tickets to other eligible persons, but in doing so the purchaser waives any claim he/she mightotherwise have to any prize. Purchasers of Raffle Tickets may not re-sell their Raffle Tickets to otherparties, and may not knowingly give Raffle Tickets away to others for the purpose of allowing thoseother parties to re-sell such Raffle Tickets. All Raffle Tickets which have been resold in violation ofthese Official Rules shall be considered void. All individuals who re-sell, purchase, or receive RaffleTickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a prize.A winner may transfer his/her prize to a third party provided that the following conditions are met: (a)the transferee would have otherwise been eligible to enter the Raffle (age twenty-one (21) or older, aresident of the State of Arizona and successfully complete a background check); (b) the transfereeshall be responsible for all taxes and costs described in these Official Rules; and (c) the transfereeshall be bound by all terms and conditions of these Official Rules that are applicable to the winner.

12.Judges. The Raffle will be conducted and supervised by the Charity, whose decisions are final. TheCharity reserves the right to modify these Official Rules at any time. The Charity reserves the right, inits sole discretion, to cancel or suspend the Raffle should unauthorized human intervention or othercauses corrupt the administration, security, fairness, integrity or proper operation of the Raffle.

13.Release of Liability. By entering into the Raffle, all entrants agree to: (a) be bound by these OfficialRules; and (b) release the Charity and any of their respective affiliates, members, partners, officers,directors, successors, assigns, representatives, City of Goodyear, and agents, including advertisingand promotion agencies from any and all liability with respect to any injury, damage or loss that mayoccur, directly or indirectly, in whole or in part, from the participation in the Raffle, or from any activityrelated to the receipt or use of any prize.

14.Publicity Release. Each winner, by entering the Raffle, grants the Charity and its designees andaffiliates, full permission, except where legally prohibited, to use such winner’s name, photograph,voice and/or other likeness, and prize information for advertising, trade andpromotional purposes without further compensation and without notice, review or approval, in all medianow known or hereafter discovered, worldwide and in perpetuity. Each winner shall execute alldocuments that the Charity may require to be signed in connection with this release.

15.Governing Law. The Raffle and these Official Rules shall be subject to and governed by the laws of theState of Arizona. If a court of competent jurisdiction finds that any provision of these Official Rules, ortheir application to a particular persons or circumstances, is invalid or unenforceable to any extent,then the remainder of these Official Rules shall remain enforceable to the fullest extent permitted bylaw. The venue for any cause of action arising out of the Raffle or these Official Rules shall be locatedin Maricopa County, Arizona.
